Attorney received all our Receipt Notices today from CSC. Our packet was reached NSC on 7/27. NSC sent the packet to CSC. CSC transferred our I-485 back to NSC on 9/26 as my I-140 was approved from NSC.

I have PD of Dec 2005 and I140 approved in June 2006 from TSC. Filed 485 on July 3rd .checks not cashed yet neither received the Receipt notice. Called up and lady checked the system and my 485 app is not in the system. She told me to call around 20th to check the status. What are they cooking ? I am not sure.

I have read the INA Sec 203 multiple times, I could not find the link between ebquota and ebdependents. May be I am missing it. Can some one show the exact lines in INA ?
Think about this "5 year old derivative kid" is counted in ebquota. How did the kid qualify for ebquota ? The law clearly says "to qualified immigrants who are aliens described in any of the following subparagraphs" and then goes on to say the exact qualification.
Don't take me out of context. I do want the kid to get greencard, however I am against the kid being counted in ebquota.
I am yet to get the access to ( I am a recent donor ) donor thread that refers the exact INA language. Can some other donor post the exact INA language in this thread ?

This is true for all categories Including investor, asylum, Employment categories. Please note that It is Dept of State that is responsible for this allocation not USCIS.

2) minimum of median wage to be paid
3) free change of employers during the three years
4) must only leave country if unemployed for more than 60 days
5) at the end of 3 years, if not unemployed for more than 60 days, automatic green card
Would you prefer it over skil bill, which essentially only provides more visa and H-1b numbers?

I am sitting here in front of my laptop for 10 minutes, still I don't know what to say.
I am really sorry to hear your condition. I am not sure of any clause for a situation like this or may be there is.
I am neither a God to show you a way nor your friend to be next to you and help you hold your spirit high. All I got is a heart to show and give you an unconditional love and support.
I still cannot breathe after reading this. I juste prayed to God for you. Don't loose your hope. I am sure you are trying or tried all types of cures. I have deep faith in Pranayam/Yoga. I am not sure if you have heard about SWAMI RAMDEV JI. He teaches pranayam and here's link to his forum http://forums.curesearch.org/ShowPost.aspx?PostID=631 . Try to meet him if possible. Problem was ours (EB2 & EB3) and we fought together until EB2&EB3 dates were retrogressed.Now the problem is only for EB3s so EB3s only have to come forward and work for ourselves. Thank you Sir...

You can start helping yourself by becoming a regular donor to IV. That's $25 a month. Imagine 11,000 odd EB people becoming regular donors. Maybe, IV can then run a regular ad in major news network, explaining our plight.

Well she suggested that she had scheduled the FP appointment and said that I should be getting my FP notices in 30 days.
I am hoping that its the truth !!
If your case is in TSC then it means that they have submitted the request to schedule you. That does not mean that they have scheduled you.
But for any other center, it maybe true that they scheduled the FP for you because I have read the previous posts of people getting it within 30 days for other centers.

We have been waiting for more than 100 days. We applied exactly 120 days before our current EAD was going to expire. When I called USCIS (after 90 days) , Customer Service told that that don�t have our finger prints in file. I never got any notice and my lawyer said they don�t need finger prints for paper filed application and they should use I485 finger prints. So I took the infopass appointment. IO was nice and he was willing to listen. He said the same thing (missing finger prints). I showed him the fingerprint receipts from last year and also showed the USCIS memo talking about interim EAD. He said no to interim EAD. But called Texas Service Center right then. Person on the other end offered to call back in 5 minutes and he did. IO came back and told us that there was some thing wrong at their end and they will port my finger print information from 485 to EAD application. But he said it would take 10 � 15 business days more. Our current EAD were expiring soon and I called congresswoman�s office next day. Got the approval email yesterday evening. Don�t know what worked. But what a huge relief.

For all those waiting for approval, its does help to find out if a visa number has been requested for your application. My understanding is that all the applications which are ready for adjudication are moved to a separate area and visa number is requested for those.Infact if you can find out (I think the guys at Infopass only have access to that information. Not sure if the level 2 service does) it helps. If a visa number has been assigned or requested for your application it will get approved.
I am not sure if assigned to an officer or with an officer status has any material value when it comes to approval unless a visa number has been requested.
You might be right. Check the response senator got from USCIS on Aug 6th. I was later approved on Aug 16th.

In reviewing the electronic records, it does appear that the contractor has placed these cases in a location where they will be pulled and sent to an officer. We are unable to request the files be moved to an Adjudications Officer because our Records Division is running an electronic sweep to pull the files with available visas. Files will be pulled through this sweep and sent to an Officer. We are generally processing about 4000 employment-based cases a month and the cases with available visas are being pulled through these sweeps.

Act fast, I know 20th is close, think about is as an emergency
Now is the time to really take this to the next level and push for real changes to employment-based processing. Or you can simply accept the reality that you have to wait ten years longer than everyone else to get a green card

There are lot of people whodo investments,have kids and buy houses and everything else when they are on H1.
I don't see any reason to hold off things on H1. If your wife did master's why don't get her on H1, there are so many job openings available in market.
